Chapter 1 General Provisions

Article 1 These Measures are formulated in accordance with the relevant laws and regulations of the state in order to standardize the safety technical training, assessment, and certification work of special operators, prevent casualty accidents, and promote safe production.

Article 2 These Measures apply to all units and special operators involved in special operations within the territory of the People's Republic of China.

Article 3 The term "special operations" as mentioned in these Measures refers to operations that are prone to casualties and cause serious harm to the safety of the operator himself, others and the surrounding facilities.

Special operations include:

(1) Electrical work;

(2) Metal welding and cutting operations;

(3) Operation of hoisting machinery (including elevators);

(4) driving a motor vehicle within the enterprise;

(5) Elevation and erection operations;

(6) Boiler operation (including water quality testing);

(7) Operation of pressure vessels;

(8) Refrigeration operations;

(9) Blasting operations;

(10) Mine ventilation operations (including gas inspection);

(11) Mine drainage operations (including tailings dam operations);

(12) Other operations proposed by the comprehensive safety production management department of the province, autonomous region, or municipality directly under the Central Government or the industry competent department of the State Council, and approved by the State Economic and Trade Commission.

Article 4 The term "special operations personnel" as mentioned in these Measures refers to the personnel directly engaged in special operations.

Special operations personnel must meet the following basic requirements:

(1) At least 18 years old;

(2) Being in good health and free from diseases and physical defects that hinder the corresponding types of work;

(3) Have a junior high school education or above, have the safety technical knowledge of the corresponding type of work, participate in the safety technology theory and practical operation assessment stipulated by the state and pass the test;

(4) Other conditions that meet the needs of the characteristics of the corresponding type of work.

Chapter 2 Training

Article 5 Special operators must complete theoretical studies and practical training on safety technology that are suitable for their type of work before starting their own work independently.

Article 6 The unit responsible for the training of special operators shall have the corresponding qualifications, and shall be reviewed and approved by the comprehensive management department of production safety of the province, autonomous region, or municipality directly under the Central Government or its entrusted comprehensive management department of production safety at the prefectural or municipal level.

Article 7 The unit that has obtained the training qualification shall be re-examined by the original examination and approval institution every 5 years. Only those who pass the re-examination can continue to engage in the training of special operations personnel.

Article 8 The safety technical training assessment standards and basic training materials for special operators shall be formulated and organized by the State Economic and Trade Commission.

Article 9 The training unit shall submit the training plan, instructor qualifications and other materials to the assessment and certification unit for record.

Chapter III Assessment and Certification

Article 10 The assessment and certification of special operators must adhere to the principles of fairness, fairness and openness, and no fraudulent practices are allowed.

Article 11 The safety technology assessment of special operation personnel is divided into safety technology theory assessment and practical operation assessment. The specific assessment content shall be implemented in accordance with the "Special Operations Personnel Safety Technology Training Assessment Standards" formulated by the State Economic and Trade Commission.

Article 12 The unit responsible for the assessment of special operators shall have the corresponding qualifications, and shall be examined and approved by the comprehensive management department of work safety in the province, autonomous region, or municipality directly under the Central Government.

Article 13 Personnel participating in the qualification assessment for special operations safety operations shall fill out an assessment application form, and the applicant or the employer of the applicant shall submit an application to the local unit responsible for the assessment of special operations personnel.

After the assessment unit receives the application for assessment, it shall organize the assessment within 60 days. Those who pass the examination will be issued a corresponding special operation certificate; those who fail the examination are allowed to make up the examination once.

Article 14 The special operation certificate shall be prepared by the State Economic and Trade Commission, and shall be issued by the comprehensive management department of production safety of the province, autonomous region, or municipality directly under the Central Government or the comprehensive management department of production safety at the prefectural or municipal level entrusted by it.

The special operation certificate is common throughout the country.

Article 15 The special operation certificate shall be reviewed once every two years. For those who have continuously engaged in this type of work for more than 10 years, the re-examination time can be extended to once every 4 years after the employer conducts knowledge update education.

Article 16 The review of the special operation certificate shall be submitted by the special operation personnel or the employer within the validity period, and the local assessment and certificate issuing unit shall be responsible for the review.

The content of the review includes:

(1) health check;

(2) Inspection of illegal operation records;

(3) Education on new knowledge about production safety and accident cases;

(4) Examination of safety knowledge for this type of work.

Article 17 If the re-examination is qualified, the re-examination unit shall sign, register and confirm it. Those who fail the re-examination may apply to the original re-examination unit for re-examination within 30 days from the date of receiving the notice. The re-examination unit may re-examination once more according to the application. If the re-examination is still unqualified or the re-examination is not scheduled, the special operation certificate will become invalid.

Article 18 Special operators who are engaged in cross-regional or mobile construction units may apply for reexamination to the assessment and certificate-issuing units in the place where they work or construct.

Chapter IV Supervision and Management

Article 19 Special operations personnel must hold certificates to work. Those who work without a certificate shall be punished according to the relevant regulations of the state.

Article 20 Employers shall strengthen the management of special operations personnel, and do a good job in the organization of declaration, training, assessment, review and daily inspection.

Article 21 The certificate-issuing unit and the employing unit shall establish files for special operators.

Article 22 The comprehensive production safety management departments of provinces, autonomous regions, and municipalities directly under the Central Government shall submit to the State Economic and Trade Commission at the beginning of each year statistics on the training, assessment, certification, and review of special operations personnel in the region in the previous year.

Article 23 The special operation personnel of cross-regional or cross-regional mobile construction units must accept the supervision and management of the local safety production comprehensive management department.

Article 24 Under any of the following circumstances, the certificate-issuing unit shall confiscate its special operation certificate:

(1) Failing to accept the re-examination as required or failing to pass the re-examination;

(2) Violations of regulations have caused serious consequences, or violations of regulations have been recorded for more than 3 times;

(3) Obtaining a special operation certificate by defrauding;

(4) It is confirmed that the health status is no longer suitable for continuing to engage in the specified special operations.

Article 25 Special operation personnel who have left the special operation post for more than 6 months shall re-take the actual operation assessment, and may not start work until they are confirmed to be qualified.

Article 26 The special operation certificate shall not be forged, altered, lent or transferred.

Article 27 Those who engage in the evaluation, certification and review of special operators who abuse their powers, neglect their duties, engage in malpractices for personal gain shall be given administrative sanctions; if a crime is constituted, they shall be investigated for criminal responsibility according to law.

Chapter V Supplementary Provisions

Article 28 According to work needs, the State Economic and Trade Commission may entrust relevant institutions to examine and approve the qualifications of special operation personnel training units and assessment units, and issue special operation certificates.

Article 29 The comprehensive safety production management departments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation measures in accordance with these regulations.
